Terms of Service

1. Scope

These terms apply to the use of the website and the functions of Auditicus Express by consumers and businesses. The provider is the entity named in the Legal notice.

The service gives recommendations only and does not guarantee any result.

2. Services

Auditicus Express checks publicly accessible links (e.g. websites, profiles, posts, videos, map listings) automatically and shows indications for improvement. The free check can be used without an account. Extended reports and further functions may be provided after confirmation by e-mail or, once offered, for a fee.

3. Free use

No lasting contractual relationship arises for the free check. We may change the scope, availability and usage limits (e.g. requests per period) at any time or discontinue the service. There is no entitlement to permanent availability.

4. User obligations

  • You may have only links checked that are publicly accessible and whose checking is lawful.
  • It is prohibited to overload the service, to query it in an automated manner on a large scale, to circumvent security measures or to misuse the service to attack third parties or internal networks.
  • You are responsible for the content and information you enter (e.g. in reviews) and must not infringe the rights of third parties.

5. Results, no advice

The results are based on automated analyses of publicly available data at the time of the check. We do not guarantee completeness, accuracy or any particular success (e.g. better ranking or reach). The results do not constitute legal, tax or investment advice. Third-party platforms may change their rules and data at any time.

6. Reviews

By submitting a review, you confirm that it is based on your own experience and is truthful. You grant us the non-exclusive right to publish your name and text on the website after approval. We may reject or remove reviews that are unlawful, insulting or obviously untrue. Further details are set out in the Privacy policy.

7. Paid functions

For paid functions, the terms displayed before purchase additionally apply, with prices (including VAT), payment methods, term, termination and information on the right of withdrawal. Consumers may terminate contracts for continuing services via the cancellation button provided in each case. As long as no paid function is offered, no payment obligations arise.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. For free use, the following applies: we are liable only for intent and gross negligence, except for injury to life, body or health. Mandatory statutory consumer rights remain unaffected.

9. Customer area ("Pult")

Account: An account is required for paid packages as well as for certain features of the free account area. You are obligated to protect your access credentials (access to your email inbox) against unauthorized access and to inform us without delay of any identified unauthorized use of your account.

Linked third-party accounts: By linking a social media account, you grant us the right to access the respective platform in your name and in accordance with your respective authorization (e.g. to check or publish content). You remain solely responsible to the respective platform for compliance with its terms of use. We accept no liability for actions, changes, or blocks on the part of the respective third-party platform (cf. existing § 5 "Results, no advice": third-party platforms may change their rules at any time).

Push notifications: Push notifications are a voluntary additional feature and require your consent at the device/browser level. For their technical delivery we depend on the infrastructure of the respective browser/operating system provider; we make no warranty as to a particular delivery speed or guarantee of delivery.

AI-assisted posts — usage limits: The number of post texts finally generated via the AI function per billing period is limited by your package (see pricing page). Drafts and text adjustments prior to final generation are unlimited. Unused post quotas are not carried over to the next billing period unless stated otherwise on the pricing page.

Teams (Agency): The number of team members you may invite depends on your package (see pricing page). You, as the inviting person, are responsible to us for the conduct of invited team members within your account.

Availability, backups: We take reasonable technical precautions (among others, daily data backups) to protect against data loss, but make no warranty of uninterrupted availability of the service or of complete recoverability in the event of a technical failure outside our sphere of influence.

Setup assistant for social media accounts: The setup assistant serves only to orient you and pre-fill text; it does not register accounts automatically. Registration is carried out by you yourself on the official site of the respective platform and is subject to that platform's own terms. You are responsible for the accuracy of the information you enter in the assistant (e.g. username).

10. Data protection

Information on the processing of personal data can be found in the Privacy policy.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the mandatory provisions of the state in which they have their habitual residence. If the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is [ORT].
